The definition of a real estate agency is as set forth in the regulations adopted under the Real Estate Settlement Procedures Act. A licensed real estate agent is one who has been approved by the Office of the Secretary of State to represent residential customers on behalf of a lending party. This agent must be registered with the Office of the Secretary of State as an agent of the lender, and he or she must obtain a real estate license from the county clerk. One can become a licensed real estate agent by fulfilling all of the licensing requirements under the act and by paying a fee prescribed by the secretary.

b. "Citation Needed" - The persons required to be referred to as buyers are those who apply for loans on the real property and who are looking for the purchase of such real property. A borrower may also apply for a loan on his or her own but, if such person is unsuccessful then the mortgage company or another real estate agency may refer such buyers to the buyer. However, when borrowers apply for a loan under the act such buyers are referred to as purchasers and the lender's agent on behalf of such buyers is referred to as lienor.

c. "licensure." The real estate agencies from this homepage are required by the act to register with the Department of Licensing and Certification and obtain an authorisation code number. These codes are often termed "licensing conditions." After getting the appropriate code the agency gets the permission to use such words or names as used in the business to describe its members. The authorisation code may specify the minimum standards of integrity, honesty and knowledge required from the agents of the agency to ensure that these standards are complied with.

d. "Offers." The New York Rent Own Sell real estate agents also provide the services of advertising and selling for their respective clients. In order to obtain the registration of brokerage, the broker must disclose his status as a licensed seller, i.e., he has to meet the minimum qualifications of a licensed broker under the Law on Real Estate Brokers and Transactions. For this purpose, the agency provides brochures to buyers which clearly indicate that the seller is a member of the agency. Some states also require the agents to post these brochures at the office of the broker within a stipulated period of time.

e. "Sale price." Real estate agents play a major role in determining the sale price of the residential property. The agent negotiates on behalf of the buyer and ensures that the best possible price is achieved. Once the buyer confirms the deal, the agency sends a certified copy of the final sale price to the seller who is then obligated to disclose the exact price of the residential property to any person who might be interested in purchasing the said property.
